Limia Store Terms of Service

1. General Provisions.

1.1 These regulations define the rules for using the online store available at limia.pl and the rules for fulfilling orders placed through it.

1.2 The limia.pl online store is owned by OMETRA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.

1.3 The limia.pl store operates as a dropshipping distributor, providing Customers with access to a wide range of products offered by external suppliers, mainly from China, without the need for the store to stock them.

1.4 Products offered on the store's website are shipped directly from suppliers to Customers.

1.5 The store cooperates with logistics partners and suppliers to ensure efficient order processing.

1.6 The store reserves the right to introduce restrictions on the availability of its offer for specific groups of customers or regions, of which the Customer will be informed before placing an order.

2. Order Fulfillment.

2.1 Products available on the store's website are offered based on cooperation with foreign suppliers, particularly from China.

2.2 After the Customer places an order and makes full payment, the store forwards the order to the appropriate supplier, who prepares the product and ships it directly to the Customer. Unpaid orders within 3 business days may be canceled by the store.

2.3 The store's order fulfillment time is 2-3 business days, counting from the day after payment is credited. The final delivery time depends on the supplier and the Customer's location and can range from 5 to 30 business days, which the Customer accepts by placing an order.

2.4 The store is not responsible for delivery delays resulting from reasons beyond the store's control, such as actions of suppliers, logistics partners, transport delays, customs controls, unforeseen circumstances, or errors provided when placing an order, e.g., an incorrect Customer address.

2.5 In the event of a delivery delay exceeding 30 business days from the date the order was transferred to the supplier, the Customer has the right to withdraw from the contract and receive a refund, provided such a request is submitted in writing to the email address: zwroty@limia.pl within 5 business days from the expiry of the aforementioned period.

3. Purchase of Goods.

3.1 By placing an order, the Customer enters into a sales agreement with Limia.pl under the terms specified in these regulations.

3.2 The store reserves the right to refuse to fulfill an order in the event of:

  • Technical errors on the website,
  • Errors in product descriptions or prices,
  • Inability to fulfill the order due to unavailability from the supplier,
  • Suspicion of the Customer violating the regulations.

3.3 Product prices on the website are gross prices, including VAT, unless otherwise stated.

3.4 The store reserves the right to change product prices without prior notice. Price changes do not affect orders already placed and paid for.

4. Store's Liability.

4.1 The store makes every effort to ensure that product information is consistent with the actual product assessment and is updated regularly.

4.2 The store is not responsible for any changes in product availability after an order has been placed by the Customer, resulting from the actions of suppliers.

4.3 The store is not responsible for delivery delays resulting from reasons attributable to the supplier, logistics operator, or the Customer.

4.4 The store is not responsible for the quality of products supplied by suppliers but undertakes to support the Customer in the complaint process in accordance with applicable law, including GPSR.

5. Customer Data and Privacy Policy.

5.1 Customers' personal data is processed solely for the purpose of order fulfillment and in accordance with applicable personal data protection regulations (GDPR).

5.2 For order fulfillment, Customer data may be transferred to cooperating entities, such as suppliers, logistics partners, or payment operators.

5.3 Detailed information regarding the processing of personal data can be found in the privacy policy available on the store's website.

6. GPSR Product Safety.

6.1 All products offered in the store meet the safety requirements specified in GPSR and bear the CE mark, if required.

6.2 If a product is found to pose a safety risk, the store will withdraw it from the market and notify Customers by email about the return procedure.

6.3 Reports regarding product safety should be sent to the email address: kontakt@limia.pl. The store will respond within 24 hours and take action in accordance with GPSR.

6.4 The Customer undertakes to comply with the user instructions for products supplied by suppliers to ensure their safe use.

7. Complaints and Returns.

7.1 In the event of receiving a defective product, the Customer has the right to file a complaint in accordance with the provisions of the Act on warranty for physical defects, Articles 556-576 of the Civil Code.

7.2 A complaint should be submitted immediately after noticing the defect, no later than within 60 days from product delivery, in writing to the email address: zwroty@limia.pl.

7.3 The complaint notification should include: Title: Complaint, order number, description of the defect, photos of the defect, Customer contact details. Costs associated with returning the product as part of a complaint are borne by the Customer, unless the store decides otherwise.

7.4 Complaints will be processed within 14 business days of receiving a complete notification. In case of the need to contact the supplier, the processing time may be extended to 30 business days, of which the Customer will be informed.

8. Final Provisions.

8.1 The store reserves the right to change the content of the regulations at any time. The current version of the regulations is available on the website, and changes do not affect orders placed before their introduction.

8.2 Placing an order in the store means acceptance of these terms of service.

8.3 Any disputes arising from the implementation of sales contracts will be settled by the court competent for the store's registered office, unless legal provisions state otherwise.
